Springfield, IL (CAPITOL CITY NOW) – Sangamon County State’s Attorney John Milhiser is standing firm in his efforts to keep Sean Grayson in pretrial detention. Milhiser released a statement Wednesday, saying, “Grayson has demonstrated he cannot comply with conditions and is a danger to the community after his inexplicable actions on July 6, 2024, when he shot Sonya Massey.”
Milhiser has filed a petition for leave with the Illinois Supreme Court, asking it to review a November appellate court ruling that ordered a pretrial release hearing for Grayson. The appellate court found the circuit court’s decision to detain Grayson was improper.
Grayson’s pretrial release hearing was originally scheduled for Friday, but the appellate court issued a 35-day delay Tuesday providing time for the state’s attorney to pursue a further stay of the mandate directly from the Supreme Court. The hearing is now set for Jan. 2.

Milhiser remains hopeful the Illinois Supreme Court will hear the case and uphold Grayson’s detention. “If the courts determine that the evidence presented to the circuit court, including the videos, is not sufficient to detain Defendant Grayson under the law as it exists, then the law needs to be changed.”
Grayson, a Sangamon County deputy at the time of the shooting, was responding to a prowler call at Massey’s home. Body-worn camera footage shows Grayson shooting Massey in her kitchen.
