Springfield, IL (CAPITOL CITY NOW) – Criminal charges have been filed against David Yankee in the drowning death of a 7-year-old child Barrett Koches. The indictment alleges Yankee knowingly caused or permitted the life or health of a child under the age of 18 to be endangered by leaving him at home unattended on March 16 for over an hour under the supervision of a 10-year-old and 4-year-old.

Per a release from Sangamon County State’s Attorney John Milhiser, a grand jury returned the indictment Wednesday containing four counts of endangering the life or health of a child. Under Illinois law, “unattended” means not accompanied by a person 14 or older.

Count one revolved around Koches being left unattended and not accompanied by a person 14 or older. The second count alleges Yankee left B.K. with a dangerous environment in the backyard and unattended for over one hour, and the violation was a proximate cause of death to B.K. Possible penalty for conviction on count one or two is two to 10 years in prison or a sentence of probation.

Yankee is also charged with two additional counts of endangering the life or health of a child related to two other children in the home who were present when B.K. died. Possible penalty for these counts is up to a year in jail or a sentence of probation.
